These terms and conditions form an integral part of your hire contract with Coden Events.
Definitions
'Coden Events' also includes their subcontractors or agents.
'The Hirer' is the person hiring 'The Equipment' from Coden Events.
'The Period of Hire' is understood to mean the dates agreed for hire between Coden Events and The Hirer.
'The Equipment' is all equipment belonging to Coden Events.
'The Contract' is the agreement entered into between 'The Hirer' and Coden Events.
1. Conditions
Unless otherwise acknowledged in writing all orders are accepted subject to the terms and conditions stated below and The Hirer by proceeding acknowledges this.
2. Permits
The Hirer is responsible for giving notice to or obtaining permits from any authorities who are or may be concerned and must make application where necessary to the Planning Authority, Disrtict Surveyor, Police, Fire Brigade and any similar authority or organisation. Any costs incurred in delays or modifications in the work arising from the absence or misinterpretation of all such necessary permissions and permits shall be payable to Coden Events by The Hirer. Where appropriate obtain a license from the Local Authority. Any requirements under the license must be notified to us in writing, at least 28 days prior to installation. Should Coden Events for any reason be unable to comply with these requirements, then The Contract will become void and the customer advised accordingly.
3. Site
It is the responsibility of The Hirer to ensure that
a) The site is flat, level and firm, and clear of services to a depth of 1 metre of Gas, Electricity, Water and drainage pipes. Any damage caused if these are present is the responsibility of The Hirer.
b) There is easy access to the site for the delivery vehicle, and the distance from the point of parking to the point of erection is no more than 100 metres.
c) There is a plan provided showing the exact location The Equipment is to go in, or a representative on site for this purpose, unless a plan has already been completed in conjunction with Coden Events.
d) The site will be clear of all debris/obstacles on the day of installation.
4. Equipment
a) The Hirer accepts full liability for the safety of The Equipment during The Period of Hire and accepts liability for replacement of any lost or damaged Equipment at the current cost of such Equipment.
b) The Hirer shall not tamper with any part of The Equipment.
c) Coden Events will allow The Hirer to decorate The Equipment with any decorations as required on the specific understanding that these are removed at the end of The Period of Hire by The Hirer and that no residue of any kind is left on The Equipment.
d) The Hirer will not attach The Equipment to any other buildings/equipment on site without the prior consent of Coden Events.
e) No heaters or BBQ's are to be used inside The Equipment.
5. Payments
Payments must be made in accordance with the terms stated on the Invoice issued by Coden Events.
Interest will be charged on late payments at 4% per annum above the base rate of Santander Uk plc.
6. Cancellations
Cancellations less than 48 hours before the event will be subject to a charge of £50.00 to be invoiced to the hirer.
7. Additional
a) Coden Events reserves the right to refuse to hire The Equipment to any client with whom it does not wish to enter into a contractual agreement. Coden Events reserves the right to cancel a contract at any time and without notice, whereupon it will refund to The Hirer any monies paid. Following such a refund, no further liability will exist between The Hirer and Coden Events.
b) Save as provided in these conditions and to the extent that the exclusion or restriction of liability may be prohibited by statute, Coden Events will not be liable for any loss, damage or injury caused, directly or indirectly by The Equipment or its use. Your statutory rights are not affected.
c) FORCE MAJEURE. Whilst every effort will be made by Coden Events to carry out any order accepted the full performance of it is subject to variation or cancellation by Coden Events consequent upon Act of God, War, Strikes, Lockouts or any other disturbances. Fire, Flood, Storm, Gale or Tempest restrictions on the use of Transport, Fuel or Power. Requisitioning Storage of material or transport or labour or any other cause beyond the control of Coden Events.
